It should be the ball on the one yard line as Patterson's right foot was inbounds when touched the ball, and then went out of bounds. It's a penalty if the ball goes out of bounds, on a kick off. If a player is aware of it, he can go out of bounds and reach in bounds to touch the ball to down it, and then the receiving team gets the ball on the 40 yard line.
