On second thought, I'm not going to offer a free lesson in law to dumdums that choose to be ignorant.  It's my day off and talking to a brick wall(s) isn't how I plan on spending it.  

Based on what is reported: There was reasonable suspicion for the stop.  There was probable cause for the warrantless search of the vehicle.  The occupants of the vehicle were lawfully detained.  There was contraband located in the vehicle. One subject was cited and released. Pretty damn simple.

Lets just get down to the foundation of the argument here in the original post.

1: Marijuana should be legal

2: I don't like cops

The truth shall set you free!

The key word in your post is "opinion."  Nobody gives a fuck about your opinion.  Tell me what part of the traffic stop, from start to finish, was unlawful based on the constitution and/or case law.

Which is why the cops will claim to smell it even if there's nothing there.  It's the magic word to get them to start a warrantless search.  Never mind the exigent circumstances exception to the Fourth Amendment shouldn't exist.

 I have no reason to question the officer's ability to smell marijuana in this instance since the search of the vehicle revealed exactly what he smelled.

One of the problems with our legal system is the extent to which courts and public opinion blindly swallow anything the cops say.  It was unconscionable that the FBI didn't record interrogations, but even the newer guidelines are chock full of loopholes.

How about the court got it wrong?  As I said in my previous post, courts give way to much deference to the cops.  Think Heien v. North Carolina, in which the Supreme Court determined that ignorance of the law is in fact an excuse for cops.

I don't hold the opinion that the court got anything right or wrong... the court makes decisions and develops case law.  Why is this so hard to understand?

Martinez is playing with a club. I sure hope we are not using him to cover the running back who is on pace for a 1000 yard season in receiving. I have been reading articles about how GB is giving up too many explosive plays. I expect Pettine to try and cover Ekeler with a safety. Otherwise I expect that we can stop their run game. Rivers can sling it but I see improvement from our DBs.

Oh Mr. Justice System Worker... you never answered how many traffic stops you have conducted in your illustrious career.  I'm curious to know your experience as it relates to the odor of marijuana coming from a vehicle on a traffic stop.  

So....Let's understand the facts.

He was pulled over for driving 81 MPH in a construction zone which I'm assuming was 55 MPH. - certainly a valid reason to be pulled over (speeding)

They were most likely smoking before they got in the vehicle which is why the cop smelled pot. I can 100% guarantee you I smell it coming from my neighbors house when they smoke it & I'm not in their personal space like a cop at a drivers window. Probable cause. These are the facts & they are indisputable

Nah.    People with real life experience and common sense see a different scenario playing out. 

Car is speeding and gets lit up for a traffic stop.   Officer Blood Hound sees 3 large black guys who have more money than the avg black guy.  Probably sporting some nice jewels and obviously traveling in a nice car.    Officer Blood Hound suspects these 3 large black guys with money might be trafficking narcotics and wants to search the vehicle.   What's the easiest way to get that done?  The old "I smell marijuana" trick to create PC that can't be refuted.

Sorry to burst your bubble, little bud.   Some of your hero's are not always operating within the law.   It will be okay, snuggle up in your mommies bossom and have a good cry.

That's just the elected employees.

So in other words, you've made zero traffic stops in your career, have no real-world experience to draw from and are simply basing your opinion on more made up BS.  Cool story though... When your Justice System Worker career ends you may have a future in writing fiction novels.  Or not.
